According to public information, Seminole has over 2500 artisan contractor general liability policies inforce in Florida. Florida Insurance Challenges for 2011

We trust your 2010 ended on a high note. We all look forward to a healthy, happy and prosperous New Year!

As we kick-off 2011, Florida remains a very dynamic insurance community, full of change and possibilities. A new era of leadership begins in Tallahassee and the issues will be framed and influenced by this new team.

Several important agenda items for 2011 for agents, companies and wholesalers alike range from Workers’ Compensation reform, the Property Insurance Bill, Citizens Reform, further Commercial Rate Deregulation to Sink-Hole coverage to name just a few. Gary Fineout’s Capitol Report article in the December 2010 issue of Florida Underwriter magazine discusses many of these issues and more. Here’s the link to Gary’s article. Make sure your voice is heard in Tallahassee!

Another interesting topic for the wholesale community and our retail agents will be the Non-Admitted and Reinsurance Reform Act (NRRA). This becomes the law of the land on July 21, 2011. It is a part of the Dodd-Frank Wall Street Reform and Consumer Protection Act. For the most part, the Act deals with the taxation of E&S premium for multi-state risks as well as regulation of the E&S industry when working with multi-state risks – the “home state” of the risk. It has been left to the states to determine and agree on the premium collection and tax allocation by state. Often referred to as the “Big Broker Bill”, its’ implementation could result in a tax savings windfall for the multi-state risk. Conversely, there is the potential loss of premium tax revenue (and assessments) for the state of Florida and others. Don’t get caught off guard by your clients on this one!

Remember – the Florida Hurricane Cat Fund assessment increased to 1.3% effective January1, 2011. This is due to increasing losses from the 2005 hurricanes – it will be levied from January 1, 2011 to December 31, 2016.

As 2011 moves forward here a few Florida statistics you might find interesting:

  • Employees in the Insurance Industry – 124,100
    (Source: State of Fl. Agency for Workforce Integration)
  • New, Admitted Property Insurance Carriers in Florida must have at least $5,000,000 in policyholders surplus to obtain a license. New, Non-Admitted carriers must have $15, 000,000 in policyholders surplus.
  • Citizens has the largest number of property insurance polices in Florida with 18% of the residential market. Their total exposure (residential and commercial) is $457 billion – their surplus during the 2010 hurricane season was about $4.6 billion (excluding Cat Fund reimbursement and bonding capability).
  • Florida Hurricane Cat Fund – maximum exposure for the current contract year is $18.8 billion; would require additional bonding requirements of $9.4 billion over existing resources to pay their maximum actual obligations for the current year – this would result in an assessment of almost 3% annually for 30 years.
  • Sinkholes – reported claims in 2006 – 2,360; in 2010, 6,694 reported claims. Sinkhole costs increased from $209 million in 2006 to $406 million in 2010.
